Terms of Service

1. Acceptance of Terms

By accessing or using the Kynvo platform at kynvo.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Kynvo is an AI-powered marketing automation platform that enables users to build visual workflows, generate marketing content using AI models, and manage campaigns. The Service includes access to workflow nodes, templates, AI provider integrations, and collaboration features.

3. Account Terms

• You must be at least 18 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Impersonate any person or entity
• Transmit spam, chain letters, or unsolicited marketing
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to develop a competing product

5. AI-Generated Content

Ownership: You retain ownership of all inputs you provide to the Service (product briefs, brand guidelines, etc.). You own the AI-generated outputs created through your workflows, subject to the terms of the underlying AI providers.

No Guarantees: AI-generated content may contain inaccuracies, biases, or errors. You are responsible for reviewing, editing, and approving all content before publishing or distributing it. The Glass Window feature is provided to help you audit AI decisions but does not guarantee content accuracy.

Third-Party AI Providers: The Service routes requests to third-party AI providers (Anthropic, OpenAI, Google, and others). Your use of these providers through our platform is also subject to their respective terms of service.

6. Payment Terms

The Starter plan is free. Paid plans (Pro, Enterprise) are billed monthly or annually as selected at signup. Prices are in USD. You can cancel at any time; cancellation takes effect at the end of your current billing period. Refunds are not provided for partial billing periods.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

8. Limitation of Liability

To the maximum extent permitted by law, Kynvo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claims under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violations of these terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting support@kynvo.ai.

10. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or a prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
